The Indian government launched the Digital India campaign in 2015. The purpose of this campaign was to ensure that all of its services are easily made available electronically to citizens through an improved online infrastructure. This was done to advance the country’s digitization and make people digitally literate and bring transparency to the way government works.

One such facility, digitally enhanced, enabled people to obtain their marriage certificates digitally or online.

When people register their marriages, it serves as proof that a marriage has been entered into between two parties. This certificate is useful in several ways. For example, if you want to get a divorce, you need a marriage certificate. It is useful to register your marriage as it comes in handy when applying for many government documents such as PAN, passport and visa after marriage. Marriages between Hindus are governed by the Hindu Marriage Act 1955 while the Special Marriage Act applies to all citizens of India regardless of their religion.

Who do you contact for marriage registration?

The sub-divisional judge in whose jurisdiction the marriage took place or where one of the spouses resided at least six months before the marriage is to be addressed for the purpose of registering the marriage.

Requirements for issuing a marriage certificate:

  • The groom must be 21 years old
  • The bride must be 18 years old
  • Two witnesses (three in the case of a marriage under the Special Marriage Act)
  • Affidavits

Required documents for marriage registration

The following documents are required to register the marriage:

  • Marriage application form duly signed by husband and wife.
  • Documentary evidence proving the date of birth of both parties (This document may be in the form of a matriculation certificate/passport/birth certificate). This age is 21 for males and 18 for females under both the Hindu Marriage Act and the Special Marriage Act.
  • Proof of residence of husband and wife (Ration Card, Aadhar Card, Election Voter ID, PAN Card or utility bills etc.)
  • Two passport photos of both parties and one wedding photo.
  • Wedding invitation card, if any.
  • If the marriage took place in a religious place, a priest’s certificate is required for the marriage.
  • In the case of a marriage under the Hindu Marriage Act, a sum of Rs. 100, and Rs. 150 in the case of a marriage under the Special Marriage Act, must be submitted to the District Treasury. The receipt must be attached to the application form.
  • The parties must affirm that they are not related and do not fall under the level of prohibited relationship as stipulated in the Hindu Marriage Act 1955 and the Special Marriage Act 1955.
  • Certified copy of divorce decree/decree if divorced and spouse’s death certificate if widow/widower.
  • If either party is of religions other than Hindu, Buddhist, Jain and Sikh, a certificate of conversion is required from the priest who performed the marriage (in the case of Hindu Marriage Law).
  • Affidavit by both parties stating the place and date of marriage, date of birth, marital status at the time of marriage and nationality.
  • The documents required for the court marriage registration process are very similar to the documents required for marriage registration.

All documents except receipt must be certified by a Gazetted Officer.

Marriage registration criteria

After examining the documents, a filing date will be set, which will be communicated to the parties. Both parties, along with the Gazetted Officer who attended their wedding, were required to be present before the Sub-Divisional Magistrate that day. After all verifications and proper procedures are completed and the SDM is met, the certificate is issued the same day.

How to Download Marriage Certificate Online?

Several states in India have now expanded the ability to allow married couples to download their marriage certificates online. In this context, various state governments have launched a registry office portal for marriage certificates and other documents such as birth and death certificates. To submit the application online, you must have scanned copies of valid documents to upload and photos from the wedding ceremony. Citizens are assisted with marriage certificate, rectification, etc. and status is provided via both SMS and personal emails.

How to Get Marriage Certificate in Delhi

Once all the documents and photos are ready, you need to make an appointment. This appointment can be made online or by visiting the competent court.

Online appointment application:

  • Click on “Make an appointment with DM” and register
  • Choose your district and continue
  • Enter the husband’s details and select “Registration of Marriage Certificate”.
  • Fill out the marriage certificate form and select the date of the appointment
  • Click on “Submit application”.
  • Get a confirmation page with your appointment details and instructions
  • Take a printout of the confirmation

Marriage Certificate Fees

Delhi marriage certificate fees are as follows:

  • Rs. 100 in the case of the Hindu Marriage Act
  • Rs.150 in case of Special Marriage Act

The fees must be deposited with the district treasury and the receipt must be attached to the application form.

Obtaining marriage license in other states

  • One can download marriage registration form and marriage certificate form of different states. For example, in Gujarat, one can use the Gujarat Marriage Registration Forum and the Gujarat Marriage Certificate Form. The same forms also exist in other states with the names of the respective states.

The Delhi government established a Tatkal service in 2014, which is working to issue a proper certificate of a marriage in an expedited process. The Tatkal service is a quick, single-day marriage authorization that prioritizes the registration process. The service allows citizens to register their marriage and get a certificate within 24 hours by paying Rs. 10,000 as a fee.

How to update your marriage license

Here are some ways you can have your marriage license updated or your name changed:

  • Errors in the marriage certificate: If you have written your married name on the certificate and some other details need to be changed, a simple notarized affidavit must be submitted to the registrar for correction in the certificate.
  • Name Change in Marriage Certificate: If the marriage certificate contains the name before the marriage, ie the title has not been changed, the name change can be done by a notarized affidavit declaring the intention to change the name after the marriage. The registrar will issue a new certificate upon submission of a draft application along with the required fee for the change.
  • Name change with marriage certificate: In cases where the marriage certificate contains the marriage title, the name can be changed upon application in the government gazette.
  1. Submit a name change form, attach a copy of the marriage certificate and pay the fee required for the procedure.
  2. The official responsible will issue a receipt for the application
  3. Once this is done, 4 copies of the Official Gazette containing your application details and changed name will be sent to the address given in the application.

The whole procedure takes about 15-20 days.
